yea i know but i heard insurance compaines will look and say they were tampered with and could end up not paying anything i dont want that just because of tinted tails i would rather just have the reg red look of led tails then to risk that

rear ending is rear ending. my friend got rear ended and his lights were completely black. its the other drivers fault since they were distracted or not paying attention.

It may not be your fault if someone rear ends you, but if a strict cop show up to work it I bet you'll get a ticket too. They'll probably claim it contributed to the accident.

How about asking your insurance company. Don't tell them who you are though. You could ask them if they have any policies or restrictions for vehicle modifications. I would imagine that anytime you do a modification to your vehicle that is not legal or you use non DOT approved lights there is always a potential for something like that to happen.

While doubtfull in all circumstances... they can make it much more difficult for you by stating they could not see your brake lights (Due to your modding them/painting/tinting them) whether they could see them or not...

Then depending on your insurance, your state laws, police report etc a number of variables could happen.
To include both parties being found contributing factors in the accident and being ticketed/fined
