Exactly the same way they (and just about any other car maker) sell problematic cars- first year design problems.
Up until 2010, this version of AFM was a "first year" design, and obviously had some bugs left to work out. With their balls being squeezed by the EPA, they couldn't just ditch the idea. They had to keep their head to the grindstone and improve it, and they did. IMO, AFM isn't worth the risk with how little fuel economy it gains and the first revision only improved its reliability, not it's effectiveness. But, it met the challenges the EPA presented. The new DFM stuff is a lot better. But, still, it's a complex system with many more failure points, as many 2019+ owners are realizing.
